These Terms of Service ("Terms") govern your access to and use of kalonslab.com (the "Site") and the services offered by Kalon's Lab, operated by Marc Prades Rovira, a sole trader based in Puerto del Rosario, Fuerteventura, Canary Islands, Spain ("Kalon's Lab," "we," "us").

By purchasing or using our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Eligibility

You must be at least 18 years old to use our services. By placing an order, you confirm that you are 18 or older.

You may only upload photos of yourself, or of another person who has given you their explicit permission to have their photos analyzed through our service. You confirm that you have the right to upload any photo you submit to us.

2. Description of Service

Kalon's Lab provides a personalized report analyzing facial features, grooming, and style, generated with the assistance of artificial intelligence. Depending on the plan purchased, this report may also be reviewed by a member of our team before delivery, and may include an action plan and a visual projection based on your measured features.

Our service is for informational and motivational purposes only. It does not constitute medical, dermatological, psychological, or surgical advice, and no part of our service should be treated as a diagnosis or a recommendation for any medical or surgical procedure. All suggestions provided are limited to grooming, styling, and non-invasive habits. If you have a medical or dermatological concern, please consult a qualified healthcare professional.

Results, recommendations, and projections are based on the photos and information you provide, and are inherently subjective and estimative. We do not guarantee any specific outcome, and individual results may vary.

3. Orders and Payment

  • All prices are listed in the currency shown at checkout and are due in full at the time of purchase.
  • We offer one-time purchases only; we do not currently offer subscriptions.
  • Payment is processed securely through our third-party payment providers (Shopify Payments and/or Stripe). We do not store your full payment card details.

4. Delivery

After you complete your purchase and upload the required photos, your report will typically be delivered to the email address associated with your order within the timeframe stated on the Site at the time of purchase. Delivery times are estimates and may occasionally vary due to demand or technical issues.

5. Refund Policy

If you are not satisfied with your report, you may request a full refund within 7 days of the date your report was delivered, no questions asked. To request a refund, contact us at thumbnify.co@gmail.com with your order number.

Refunds will be processed to your original payment method within a reasonable time after approval. This refund policy is offered in addition to, and does not limit, any statutory right of withdrawal or refund you may have under the consumer protection laws of your country of residence.

6. Your Content and License to Us

You retain all rights to the photos you upload. By uploading them, you grant us a limited, non-exclusive license to use them solely for the purpose of generating and delivering your report, as described in our Privacy Policy. We do not use your photos for any other purpose, including advertising or training third-party AI models, and we delete them according to the retention periods set out in our Privacy Policy.

7. Intellectual Property

The Site, our report templates, methodology, and all related content (excluding your own uploaded photos) are the property of Kalon's Lab and are protected by applicable intellectual property laws. Your completed report is provided to you for personal, non-commercial use only, and may not be resold, redistributed, or used for any commercial purpose without our prior written consent.

8. Prohibited Uses

When using our service, you agree not to:

  • Upload photos of anyone under the age of 18.
  • Upload photos of another person without their explicit consent.
  • Use the service for any unlawful, fraudulent, or harmful purpose.
  • Attempt to reverse-engineer, copy, or resell our methodology, reports, or underlying technology.
  • Interfere with the proper functioning of the Site.

We reserve the right to refuse service, cancel orders, or terminate access for any user who violates these Terms.

9. Disclaimers

The Site and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kalon's Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or liability that cannot be excluded under consumer protection law applicable in your country of residence.

11. Indemnification

You agree to indemnify and hold Kalon's Lab harmless from any claims, damages, or expenses arising from your breach of these Terms, including your violation of Section 1 (Eligibility) or Section 8 (Prohibited Uses).

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law and Your Statutory Rights

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Nothing in these Terms affects any mandatory consumer protection rights you have under the law of your country of residence, which remain fully applicable and take precedence over any conflicting provision in these Terms.

Any dispute will be submitted to the courts of the consumer's domicile where mandatory consumer protection law so requires, or otherwise to the courts of Las Palmas de Gran Canaria, Spain.
